Terms of Service
1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the TreeChain encrypted data infrastructure platform, including all APIs, SDKs, documentation, and related services (collectively, the “Service”). By accessing or using the Service you agree to be bound by these Terms.
TreeChain is operated under patent application
EP26025007.1 and is subject to the jurisdiction of the Republic of Poland
and applicable European Union law.
2. Acceptable Use
Prohibited content and activities. You may NOT use the Service to encrypt, store, transmit, or otherwise process any of the following:
- Child sexual abuse material (CSAM) in any form
- Instructions for the manufacture of illegal weapons or explosives
- Content designed to facilitate fraud, phishing, or financial crime
- Content that incites, promotes, or facilitates violence or terrorism
- Any content that violates the laws of the Republic of Poland or the European Union

3. Zero-Knowledge Architecture
TreeChain architecturally cannot access customer data. The Service is designed so that all customer content is encrypted client-side before it reaches TreeChain infrastructure. TreeChain does not hold decryption keys and cannot decrypt, read, inspect, or produce customer data in response to any legal request, subpoena, or court order. This is a mathematical property of the system, not a policy choice.
Because of this architecture, TreeChain’s ability to moderate content is limited to metadata-level signals (API usage patterns, abuse reports, etc.). Users bear full responsibility for the legality of the content they encrypt.
4. Liability Limitation
To the maximum extent permitted by applicable law, TreeChain’s total aggregate liability arising out of or relating to the Service shall not exceed the fees actually paid by you to TreeChain during the three (3) months immediately preceding the event giving rise to the claim.
In no event shall TreeChain be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities, regardless of the theory of liability.
5. Service Availability
TreeChain provides the Service on a best-efforts uptime basis. No specific service-level agreement (SLA) is provided unless you are subscribed to an Enterprise plan with a separately executed SLA addendum.
TreeChain may perform scheduled maintenance with reasonable advance notice and reserves the right to modify or discontinue features with thirty (30) days’ notice.
6. API Usage Limits
API rate limits and quotas are determined by your subscription tier:
- Free — 1,000 requests/day, 10 MB storage
- Pro — 50,000 requests/day, 50 GB storage
- Business — 500,000 requests/day, 500 GB storage
- Enterprise — Custom limits per agreement
Exceeding your tier’s limits may result in throttling or temporary suspension of API access. Sustained overuse without upgrading may be treated as a Terms violation.
7. Account Termination
TreeChain reserves the right to suspend or terminate your account and API keys at any time if:
- You breach these Terms or the Acceptable Use Policy
- Your usage poses a security or integrity risk to the Service
- Required by applicable law or regulation
- Your account has been inactive for more than twelve (12) consecutive months
You may terminate your account at any time through the dashboard. Upon termination, your encrypted data will be purged within thirty (30) days in accordance with our data retention policy.
8. GDPR Compliance
TreeChain is committed to full compliance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”). For details on data collection, processing, retention, and your rights as a data subject, see our Privacy Policy.
9. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of Poland and applicable European Union regulations. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Warsaw, Poland.
10. Changes to These Terms
TreeChain may update these Terms from time to time. Material changes will be communicated via email or a prominent notice within the Service at least thirty (30) days before they take effect. Continued use after changes constitutes acceptance.
